The Colorado Agricultural Heritage Protection Act

35-82-101. Short title. This article may be cited as the "Colorado Agricultural Heritage Protection Act".
35-82-102. Legislative declaration. The general assembly hereby finds and declares that commercial insect production poses risks to traditional agriculture, food security, food safety, public health, and the natural environment. This article is enacted to protect farming as well as the public within Colorado.
35-82-103. Definitions. As used in this article, unless the context otherwise requires:
(1) "Commercial insect production" means raising, breeding, keeping, or processing insects for the purpose of processing them into food for humans or animals, for commercial usage.
(2) "Existing corporation" means a corporation that was actively engaged in commercial insect production within the state of Colorado prior to the effective date of this article.
35-82-104. Prohibition of commercial insect production. (1) Commercial insect production, as defined in section 35-82-103 (1), is prohibited within the state of Colorado.
(2) The prohibition in subsection (1) of this section does not apply to: (a) Existing corporations, as defined in section 35-82-103 (2), that were engaged in commercial insect production prior to this article’s effective date. Such corporations may continue their operations at their current scale but may not expand beyond their existing capacity as of this article’s effective date.
35-82-105. Ban on sale or transport of insect-based food. (1) The transfer of products derived from commercial insect production, as defined in section 35-82-103 (1), by anyone in Colorado is prohibited.
35-82-106. Enforcement. The commissioner of agriculture shall enforce this article’s provisions.
35-82-107. Penalties. Any person who violates any provision of this article commits a civil infraction and, upon conviction thereof, shall be punished by a fine of not less than one thousand dollars nor more than five thousand dollars per day of violation.
